Lynn A. Borkenhagen, a partner in our San Diego office, has expertise in a wide range of real estate practice areas, including sales and acquisitions and commercial leasing for large-scale office, industrial, and retail projects. However, a majority of her practice focuses on two specialty areas: common interest development/Department of Real Estate regulatory work and construction contracts.

Lynn's common interest/condominium work spans a large variety of project types, including high-rise, urban in-fill, single family, mixed-use, and office/industrial development. In her residential practice, she has worked both with national publicly-held builders and smaller local builders, as well as numerous condominium converters and urban high-rise developers in preparing their community documentation and processing their projects through the California Bureau of Real Estate. Her commercial practice includes work with converters and other specialty common interest developers such as hospitals and hotels.

During the downturn in residential development, Lynn has been particularly active in representing lenders, owners, and purchasers of broken residential projects. Her involvement usually begins with the due diligence investigations to assess the status of the project, the association, and the CalBRE processing. She then works with her clients to determine their exit strategy or plans for continuing development of the project, and counsels them on how to achieve their goals based on existing conditions. Finally, she drafts the documents or modifications necessary for the client to move forward, including additional CalBRE processing, as required.

Lynn's wide-ranging experience also includes drafting and negotiating architectural/consultant contracts and construction contracts for high-rise residential, office and industrial projects. In addition, she has worked with builders and developers in creating standard form construction document packages and custom general contracts.

Prior to practicing law, Lynn worked as an architect for more than 10 years, where she designed and provided construction administration for shopping centers, medical facilities, and other commercial projects.

Lynn received her J.D., magna cum laude, from the California Western School of Law, her M.Arch. in Architecture from the University of Pennsylvania, and her B.A. from the University of Pennsylvania.
