Allen Matkins works with both secured creditors and receivers in a wide variety of contexts.

We frequently represent secured lenders seeking to enforce contractual and equitable rights to obtain court appointment of a receiver. Representative matters include obtaining court appointment of receivers to complete construction of residential subdivisions and commercial buildings, and obtaining the appointment of receivers to collect the rents and profits from commercial properties in the wake of a borrower default or other contractual dispute.

We also represent court-appointed receivers in both state and federal courts. Typical matters on which we represent court-appointed receivers include: 

  • Collecting rents and profits from commercial projects in the wake of a borrower default or other contractual dispute 
  • Supervising the completion of unfinished residential or commercial construction 
  • Administering distressed or environmentally compromised real property during the pendency of litigation 
  • Facilitating the sale of real property 
  • Enforcing the terms of a civil judgment

Allen Matkins also represents equity receivers appointed in enforcement actions brought by the Securities and Exchange Commission and other federal agencies, including actions alleging the operation of Ponzi-like investment schemes. Typical matters on which we represent equity receivers include: 

  • Taking over entities used to perpetrate the alleged schemes 
  • Conducting necessary forensic accounting 
  • Documenting how the schemes were carried out
  • Recovering available proceeds, where possible, for distribution to defrauded investors
