LOS ANGELES - April 26, 2010 - Allen Matkins Leck Gamble Mallory & Natsis LLP, a leading California business and real estate law firm, announces that attorneys Timothy McGinity and Andrew Miller have been elected to the firm partnership. McGinity and Miller are based in the firm's Los Angeles office. The election is effective as of July 1, 2010.

McGinity's practice focuses on real estate, land use and business litigation. He specializes in commercial, corporate and partnership litigation, landlord-tenant issues, writs of mandamus, writs of attachment and forfeiture matters. He has handled claims involving business torts, contracts, defamation, construction disputes, CERCLA claims, partnership, limited liability companies and alter ego claims, purchase and sale disputes, land use disputes and many other issues.
McGinity represents individuals, business entities and financial institutions, and has a variety of trial and alternate dispute resolution experience. His experience includes representing a pension fund with regard to landlord-tenant disputes for real estate holdings in California, coordinating all forfeiture matters on a nationwide basis for a bank, representing a developer of a $450 million project with post-construction issues, representing a prior land owner in a CERCLA claim, representing a financial institution concerning a commercial loan default and obtaining an $11 million writ of attachment, representing a developer in a land use dispute concerning a conditional use permit, and representing high profile clients in various real estate matters.
McGinity received his B.A. in history from San Diego State University in 1992. He received his J.D. from the University of San Diego in 2000, where he was a member of the San Diego Law Review from 1998-2000. Prior to attending law school, he was a member of the United States Navy. During his naval career, McGinity was deployed to Somalia for Operation Restore Hope. He also received two meritorious advancements, a Letter of Commendation, a Letter of Appreciation, the Navy League Award, the National Defense Medal, the Armed Forces Expeditionary Medal and Sea Service Ribbon.
Miller specializes in banking litigation and has successfully represented banks and the FDIC in numerous cases involving federal preemption, TILA/RESPA, various state-law claims, loan modifications, and reverse mortgages. Andy also handles complex commercial litigation, which recently includes: a consignee litigation for Pepperidge Farm, a satellite television dispute against DirecTV, an international shipping case for auto supplier Magna, and a civil RICO litigation. Miller is also an expert in the field of commercial landlord-tenant disputes and has handled many complex litigations for landlords.
In addition, Miller has extensive trial experience, including a 10-week jury trial concerning termination of a long-term movie-theater lease in a redevelopment project, an arbitration concerning satellite-television systems at universities, prisons, and military bases, a trial defending the seller of a commercial office building against claims by buyer regarding building's condition, a trial before Labor Commissioner of California concerning a $10 million claim under Talent Agencies Act; an arbitration concerning termination of long-term commercial lease, and a trial defending against a claim of financial elder abuse regarding a reverse mortgage.
Miller received his J.D. from Duke University School of Law in 1995. He received his B.A. from Tufts University in 1991.
