Alykhan "Aly" Shivji

Partner

Aly is a real estate partner in the New York office and co-leads the firm's data center and digital infrastructure efforts. He represents clients across asset classes, ranging from data center, residential, mixed-use, and office to hospitality and industrial. Aly’s practice covers the full spectrum of real estate investment transactions, including:

  • Single asset and portfolio acquisitions and dispositions;
  • Real estate fund formation;
  • Mortgage and mezzanine financing;
  • Joint venture agreements;
  • Preferred equity agreements; and
  • Commercial leasing, including net leases, gross leases, percentage leases, built-to-suit leases, ground leases, and sale-leasebacks.

A significant aspect of Aly’s practice focuses on the data center sector. He serves as primary leasing counsel for one of the world’s largest software and computing companies and for a global technology firm, having closed data center leases worth billions of dollars across the Americas, Europe, and Asia. Aly regularly advises data center tenants and owners on global strategic initiatives, leasing, and financing, as well as development and investment transactions. In addition to his data center practice, Aly has significant experience in the office sector, counseling hedge funds, private equity funds, and other landlords and tenants on their Manhattan leases throughout market cycles. He is an experienced negotiator dealing with sophisticated tenants and the city’s largest landlords.

  • Multinational technology conglomerate and software company. Serves as primary data center leasing counsel for one of the world’s largest technology companies, advising on billions of dollars in leasing transactions across North America and South America.
  • Global computer manufacturing and technology firm. Advises client as tenant in data center leases and related transactions across the U.S., Europe, and Asia.
  • Data center tenants. Represents leading data center tenants on global strategic initiatives and operational matters related to data center assets.
  • Global technology firm. Advises global technology company and other clients on the financing and development of data center projects.

ACQUISITIONS/DISPOSITIONS

  • Global investment firms. Advised in connection with the acquisition of a $1 billion minority interest in 1221 Sixth Avenue, New York, NY.*
  • Global alternative investment firm and hospitality investor. Represented in connection with the $1.3 billion sale of a hotel portfolio.*
  • National real estate investment firm. Advised in connection with the $570 million sale to and subsequent joint venture with respect to a 16 property multifamily portfolio.*
  • Real estate investment company. Counseled in connection with equity investments with respect to various residential, office, retail and mixed used properties in New York, Houston and Denver.*
  • One of the world’s largest asset managers. Advised on billions of dollars’ worth of acquisitions and dispositions, including a joint venture for the $128.4 million acquisition of c, a vintage 9-story industrial property in Long Island City, Queens, which will be redeveloped into an office building and the $276 million sale of a large office building located in Boston’s burgeoning Seaport District.*
  • Tokyo-based architectural and engineering firm. Represented client on its inaugural NY office investment – the $147 million acquisition of the Albano Building, a high-rise office tower in Manhattan.*
  • Counsel in the joint venture between a Japan-based real estate investment firm, as advisor to a Japanese investor, and a New York-based owner/operator. Advised on the approximately $100 million acquisition of 434 Broadway, a fully leased office and retail building in the SoHo submarket of New York City, from Savanna.*
  • New York-based real estate sponsor. Represented client with respect to a joint venture for an industrial development in Queens, NY.*
  • Japan-based real estate investment firm. Advised client in its joint venture with Meritage Properties for the $54 million acquisition and $25 million financing of an 11-story office building in the heart of Washington, DC.*
  • Canadian investment advisor. Counseled client in connection with multiple industrial acquisitions in the tri-state area.*
  • Renowned hotel developer. Advised in connection with hospitality acquisitions, financings, and joint ventures in New York, NY and Los Angeles, CA.*

REAL ESTATE FINANCE

  • REIT. Represented client in the origination of $376 million mortgage and mezzanine loans to a joint venture for the acquisition of the iconic Watchtower building in Brooklyn.*
  • Global investment bank. Advised client on the origination of $180 million mortgage and mezzanine loans for the acquisition of the NoMo Soho Hotel in Manhattan.*
  • Hospitality company. Represented client in obtaining $1.85 billion in refinancing for a portfolio of landmark hotels located in Hawaii and California, including the Sheraton Waikiki and The Royal Hawaiian.*

LANDLORD LEASING

  • Privately-held real estate company. Advised landlord on the initial lease up of 787 11th Avenue, including leases with Nissan North America and Pershing Square Capital Management.*
  • Real estate private equity firm and Canadian real estate investment firm. Represented landlords on office and retail leasing matters at 3 Bryant Park and 1211 Avenue of the Americas including transactions with News Corp., MetLife, Equinox, Whole Foods, US Bank, and Salesforce.com.*
  • Family office. Counseled landlord on retail leases in Soho and on Fifth Avenue including transactions with LVMH and Calzedonia.

TENANT LEASING

  • Public for-profit higher education operator. Represented client in connection with its headquarters.
  • Leading mobile app trivia game creator. Represented client in connection with its headquarters and broadcast studios.*
  • Popular Egyptian fast-casual restaurant. Advised client in leasing of their first U.S. location in New York City’s Nolita neighborhood.*
