Law360 (August 11, 2016) A California judge on Thursday sent to arbitration a former Loeb & Loeb LLP attorney's proposed putative class action alleging food delivery website DoorDash misleadingly inflates the costs of restaurant dishes, ruling the website sufficiently warned users they were bound by terms and conditions containing an arbitration agreement. At Thursday's hearing, Los Angeles Superior Court Judge Elihu M. Berle said that he would be granting DoorDash Inc.'s motion to compel arbitration of named plaintiff Lauren Miller's putative class action alleging the company misleads customers by both charging a delivery fee and also inflating the costs of the items it delivers compared to the cost of those items when purchased directly. Judge Berle pointed to this prevalence of similar food-delivery services as one reason why DoorDash's terms and conditions, while not negotiated between the parties, were not being unfairly applied.
