General Plans, Specific Plans, & Zoning

General plans, specific plans, and zoning are the primary foundations for land-planning in communities. At Allen Matkins, we understand how to use these tools to our clients’ advantage.

For example, we often work with clients to:

  • Fashion general plan amendments to protect a project from future legal challenges or to reduce the threat of an anti-project referendum
  • Tailor specific plans to provide greater development flexibility to help clients meet the demands of changing markets without further government approval
  • Craft regulations that better manage local growth, establish sustainable community standards, and ensure proper public services and facilities as development occurs while streamlining the approval process

EXPERIENCE

  • Airport Facility Owner. Represented client in connection with obtaining approvals from Los Angeles World Airports and the City of Ontario for the development of a new air cargo facility at the Ontario International Airport.
  • University. Represented private university in connection with obtaining approvals from the City of Azusa for new specific plan and development agreement for campus expansion. Represented client in connection with litigation against the State Historical Resources Commission for designation of drive-in movie theater owned by client as eligible for listing on the California Register of Historical Resources.
  • Golf Course Developer. Represented the developer of a golf course community in connection with CEQA compliance, and approval of a general plan amendment and specific plan amendment for the development of up to 364 single-family dwelling units, 25 membership suites, a small community serving retail component and an 18 hole championship golf course located on 1,770 acres within Dry and Tapo Canyon in the City of Simi Valley.
  • Developer. Represented client in connection with unanimous approval by the San Diego County Board of Supervisors to develop Montecito Ranch, a 935‐acre master planned community in the community of Ramona, consisting of 417 homes, parks, trails and other amenities, including 570 acres of open space.
  • Developer. Represented the developer of an 800-acre residential and country club community in connection with CEQA compliance, specific plan issues, subdivision map processing, wetland and endangered species permitting, negotiating a development agreement, a golf course management agreement, homeowner CC&Rs, and litigation in state and federal courts related to CEQA, development agreement, water supply, civil rights violations, and takings.
  • Capital Partner. Represented capital partner with securing conditional use authorization and parking agreement for medical office use.
  • Brewery. Represented client in securing conditional use authorization from City and County of San Francisco for re-establishment of historical brewery.
  • Private College. Represented private college in connection with approval by the City of Pasadena of a new Master Plan for campus development. Represented client in negotiations with the City of Pasadena for a long term ground lease for City-owned property. 
  • City. Represented City in the drafting and negotiation of specific plan and development agreements relating to planning area. Projects include resorts, commercial, residential and recreational uses.
  • Developer. Represented client in connection with the development of combined light rail transit facility and mixed-use project consisting of retail, office, and multi-family residential complex.
  • Developer. Represented client in connection with obtaining approvals for new multi-tenant retail center in the City of Palmdale.
  • Seminary. Represented private nondenominational theological seminary in connection with application to City of Pasadena for approval of new campus master plan. 
  • Developer. Represented developer in connection with securing entitlements for 200+ unit luxury residential high-rise in downtown San Jose, California.
  • Developer. Represented developer in connection with securing key entitlements for development of mixed use area of Pacific Commons development. 
  • Homebuilder. Represented major homebuilder in connection with obtaining land use entitlements for more than 150 projects throughout Southern and Central California.
  • Developer. Represented client in connection with the entitlement and development of the Snowcreek Resort in the Town of Mammoth Lakes.
  • Developer. Represented residential developer in connection with obtaining entitlements from the City of Marina for the development of 1,050 new homes on former Fort Ord.
  • Developer. Represented client in connection with possible expansion of retail project in the City of Laguna Hills.
  • Bank. Represented client in connection with entitlement strategies for residential project in the Inland Empire.
  • Developer. Represented the developer of a mixed use project in Huntington Beach in connection with successfully obtaining entitlements for a 385 unit apartment and retail project.
