Natural Resources

The Allen Matkins natural resources team helps clients with issues related to laws and regulations such as the:

EXPERIENCE

  • Telecommunications Company. Represented client with regard to processing of multiple permits and authorizations for fiber-optic cable project from Victorville to Las Vegas. Worked closely with the Bureau of Land Management in California and Nevada regarding NEPA compliance and right-of-way grant issues. Obtained 1602 Streambed Alteration Agreement, Section 2081 "take" permit, Section 404 Permit, and Section 401 Water Quality Certification.
  • Developer. Represented developer of proposed resort hotel and residential project on local planning issues, CEQA compliance, California Coastal Commission approval, state and federal wetlands and endangered species issues, and variety of related development and entitlement matters.
  • Developer. Represented the developer of 1600-acre wetlands restoration and residential development project in connection with CEQA and NEPA compliance, negotiation of a development agreement, California Coastal Commission approval, state wetlands and endangered species issues, specific plans and local coastal programs, negotiation of park and open space dedications, and assistance in litigation defense relating to CEQA and California Coastal Act compliance.
  • Developer. Represented the developer of a master planned community in connection with water supply issues, preparation and adequacy of a water supply assessment, preparation and adequacy of the water supply section of the EIR for the project, adequacy of the Urban Water Management Plan, and assistance in defending litigation challenging the adequacy of the water supply assessment and water supply section of the EIR.
  • Developer. Represented the developer of a 400-acre residential/mixed-use master planned community in connection with Endangered Species Act compliance, Coastal Act compliance, state and federal wetlands issues, CEQA, general plan amendment and specific plan matters, and environmental remediation issues.
  • Water Districts. Represented numerous water districts, reclamation districts, county water agencies, and other similar water supply entities on a variety of water rights issues including water rights transfers, securing of water rights, compliance with Reclamation Act and related matters.
  • Brewing Company. Assisted client with Multiple Species Habitat Conservation Plan and entitlements for holdings in Riverside County.
  • Brewing Company. Represented client in efforts to develop or sell to various governmental entities client's 1,000 acre property in Riverside County, including assistance on federal, state and local land use and environmental permitting issues.
  • Nonprofit Water Organization. Represented client with regard to numerous water legislative, regulatory, and litigation matters, including Audubon decision establishing public trust water rights in California.
  • Developer. Represented client in connection with obtaining approvals for 38 unit residential condominium development in City of Palm Desert and in connection with obtaining development approvals from U.S. Army Corps of Engineers and California Department of Fish & Game.
  • Developer. Represented developer of 1,000-acre master-planned community and golf course on state and federal endangered species and wetlands permitting matters.
  • Developer. Represented developer of 365-acre residential project on state and federal entitlement-related matters regarding 404 permit, 401 certification, Section 7 consultation, 1603 agreement, and 2081 agreement.
  • Developer. Assisted client with obtaining entitlements and resolving biological issues for retail project in Moreno Valley.
  • Developer. Represented client in connection with environmental permitting issue for its large master-planned community in the City of Los Angeles.
  • Developer. Represented the developer of a 900-acre master-planned community in connection with endangered species, wetlands, MSHCP, CEQA, and related issues.
  • Developer. Represented client in connection with extending environmental permits.
  • Developer. Represented the developer of a 1,780-acre master-planned community in connection with local, state, and federal regulatory permit and entitlement issues including local planning and zoning, CEQA compliance, a development agreement, endangered species, archaeological reserves, wetlands, and land exchange issues.
  • Bureau of Indian Affairs. Represented the Bureau of Indian Affairs and numerous Indian tribes including the Yakima, Flathead, Blackfoot, Shoshone, and Klamath in connection with water rights, fishing rights, and other resource-related development and protection matters in Indian lands throughout the Pacific Northwest.
  • Bureau of Land Management. Represented the Bureau of Land Management in connection with numerous grazing leases, resource management planning issues, land exchange agreements, mineral leasing, resource protection, timber leasing and rights-of-way agreements including NEPA compliance.
  • Bureau of Reclamation. Represented the Bureau of Reclamation in connection with a variety of matters including the Bay Delta Water Quality hearings, Kesterson Reservoir cleanup and litigation; Central Valley Project issues, Truckee River species protection issues, Pyramid Lake water rights issues, hydropower licensing, Reclamation Act issues, and related water matters.
