Ken enjoys a diverse practice that ranges from origination and closing of commercial real estate finance transactions to resolving financial distress situations that involve complex, multi-disciplinary legal and business issues in often intensive negotiation and litigation postures. At the origination stage, Ken represents borrowers and lenders in acquisition, construction, bridge and permanent financing involving multifamily, industrial, office, hotel, retail and development properties around the country. In distress situations, Ken represents secured creditors/lenders, commercial landlords, land developers, commercial property owners, and parties to distressed asset transactions. Ken is experienced in loan modifications, forbearance agreements, judicial and non-judicial foreclosure, receiverships, deed-in-lieu transactions, and enforcement of remedies (including in state, federal, and bankruptcy courts).
As an extension of his finance and enforcement practices, Ken is a member of the firm’s Opinions Committee, preparing and reviewing opinion letters and rendering related advice in connection with all manner of loan closing opinions.
Ken's constant focus is maximizing value for his clients, whether that requires simple, direct action or discovering and recovering value through creative legal analysis and strategy. For more complex matters, Ken utilizes Allen Matkins' deep resources to provide clients with fully integrated, seamless, and cost-effective service involving all aspects of a transaction or dispute. He orchestrates the movements of the various parties and their counsel to ensure the efficient closing of commercial finance transactions. Likewise, in circumstances of financial distress, assembling an effective team is critical to accomplishing client goals in a timely manner. This focus and flexibility has contributed to Ken's successful involvement in a multitude of successful financing transactions; foreclosures of real and personal property; distressed asset transactions; recovery of landlord claims (including above the bankruptcy cap asserted by debtor tenants); recoveries against guarantors; out-of-court workouts; and resolution of all manner of issues in reorganization and liquidation bankruptcies.
Ken has been practicing for 25 years, through several booms and busts in commercial real estate and finance markets. That experience and his knowledge base of both closing loan transactions and resolving credit disputes enables Ken to provide his clients with a unique perspective to get to the heart of the matter and deal with it proficiently.
