CEQA/NEPA

At Allen Matkins, our land use attorneys represent clients on a broad range of complex and quickly evolving issues related to the California Environmental Quality Act (CEQA), and the National Environmental Policy Act (NEPA), which appear in almost every discretionary project approval in California.

The CEQA and NEPA processes can dramatically increase project costs, and these statutes are some of the most commonly used weapons for those challenging a project. We counsel and work with our clients to formulate effective strategies to minimize these risks.

Allen Matkins attorneys have extensive knowledge of the regulatory climate surrounding CEQA and NEPA as well as in-depth experience dealing with community concerns relating to the environmental and political aspects of projects. We frequently enable our clients to proceed with their projects without controversy.

EXPERIENCE

  • Developer. Represented developer of 600+ acre commercial/industrial project on local planning issues, CEQA compliance, endangered species issues, development agreements, implementation of major road and other infrastructure programs, subdivision map issues, transition into city jurisdiction, assignment and assumption agreements, and CEQA litigation.
  • Developer. Represented developer of 100-acre residential industrial conversion project in connection with CEQA compliance, water quality and environmental remediation, development agreements, subdivision approvals, general plan amendment and specific plan issues, drainage issues, and negotiations with adjacent property owners.
  • Water District. Represented major water district in connection with CEQA compliance, local planning and zoning approvals, endangered species issues and related matters for a landmark water conservation and transfer project in San Diego, California.
  • Developer. Represented the developer of a 675-acre master-planned community in connection with specific plan and general plan issues, processing, water supply, CEQA compliance, state and federal permitting issues, airport land use plan issues, and all related entitlement issues.
  • Developer. Represented the developer of a 117-acre, 117-unit residential project in connection with CEQA compliance, general plan amendment and specific plan processing, initiative issues, local political issues, and state and federal permitting.
  • Developers. Represented five separate developers in connection with MSHCP compliance, CEQA compliance, local entitlements processing, state and federal wetlands permitting, and endangered species issues for a master development, facilities improvement, and conservation plan project on 6,660 acres. Project includes flood control facilities, five separate residential/commercial development projects on 3,000 acres, and a conservation area to be set aside pursuant to MSHCP.
  • School District. Represented the largest school district in California in connection with CEQA compliance for the development of more than 40 new school projects district-wide.
  • Developer. Represented developer as co-counsel in CEQA lawsuit against City of San Jose regarding need for substantial evidence in record.
  • League of California Cities. Amici Curiae counsel to League of California cities in precedent-setting CEQA case regarding "alternative sites" analysis in EIRs.
  • Developer. Represented developer in drafting and processing of CEQA compliance documents (EIR), General Plan Amendment and Specific Plan approvals, and a Development Agreement (and other related agreements) with City of Tracy.
  • Developer. Represented client in connection with CEQA compliance and land use approvals for the development of a mixed use project in Brea, California.
  • Public Utility District. Represented a public utility district in connection with energy facility siting, hydropower, licensing, CEQA compliance, litigation and other entitlement and development issues relating to project operations including authorization from the California Public Utilities Commission.
  • Developer. Represented client in connection with processing entitlements for large industrial projects in Chino, unincorporated San Bernardino County and Apple Valley, including CEQA streamlining and processing issues.
  • Developer. Represented developer in connection with environmental review process, including preparation of an environmental impact report, for a major mixed use development of more than one million square feet in Hollywood.
  • Developer. Represented the developer of a 117-acre, 117-unit residential project in connection with CEQA compliance, general plan amendment and specific plan processing, initiative issues, local political issues, and state and federal permitting.
